Terms of Use

Effective date: August 5, 2026

These Terms apply to the Bright Bytes Learning website and its free learning activities. By using the site, you agree to these Terms.

About Bright Bytes Learning

Bright Bytes Learning provides digital educational activities for preschoolers, early learners, and young children with special needs. The site is operated from Tennessee, United States.

Adult Guidance

The website includes activities intended for young children, but account management, purchases, communications, and decisions about a child’s use of the site are intended for adults. Parents, guardians, teachers, therapists, and other responsible adults should select and supervise activities based on the learner’s individual needs.

Permitted Use

Bright Bytes Learning grants visitors a limited, nonexclusive, nontransferable, revocable permission to access and use the free activities:

  • At home for personal educational use;
  • In a classroom, therapy setting, learning center, or school program;
  • On a classroom display, touchscreen, whiteboard, tablet, or individual device; and
  • By sharing a link to the applicable page on brightbyteslearning.com.

Uses That Are Not Permitted

Unless Bright Bytes Learning gives prior written permission, you may not:

  • Sell, sublicense, rent, or commercially redistribute an activity or its files;
  • Copy, download, republish, mirror, or host the activities on another website, platform, shared drive, marketplace, or server;
  • Modify, translate, reverse engineer, remove branding from, or create derivative versions of the activities;
  • Present the activities, artwork, characters, or other content as your own;
  • Use automated tools to scrape, copy, disrupt, overload, or test the site without authorization; or
  • Use the site for unlawful, harmful, deceptive, or abusive purposes.

Intellectual Property

The Bright Bytes Learning name, characters, artwork, activity designs, text, graphics, code, and other original materials are owned by or licensed to Bright Bytes Learning and are protected by applicable intellectual-property laws. Permission to use an activity does not transfer ownership of any content or rights.

Educational Disclaimer

Bright Bytes Learning activities are general educational resources. They are not a substitute for individualized educational planning, professional teaching judgment, therapy, developmental evaluation, medical advice, diagnosis, or treatment. Adults are responsible for deciding whether an activity is appropriate for a particular learner.

Accessibility and Individual Needs

We aim to create clear, low-distraction activities, but no single design will meet every learner’s needs. Adults should stop or adapt an activity if it causes discomfort, frustration, sensory distress, or other concerns. Accessibility feedback may be sent to info@brightbyteslearning.com.

Website Availability and Changes

We may add, update, suspend, or remove activities or website features at any time. We do not guarantee that the site will always be available, error-free, compatible with every device, or free from interruptions outside our reasonable control.

Third-Party Services and Links

The site may rely on service providers or link to websites operated by others. Bright Bytes Learning does not control and is not responsible for the availability, content, security, or practices of third-party websites and services.

Disclaimer of Warranties

To the extent permitted by law, the website and activities are provided “as is” and “as available,” without warranties of any kind, whether express or implied. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of Liability

To the extent permitted by law, Bright Bytes Learning will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of—or inability to use—the website or activities. Nothing in these Terms limits liability where doing so would be prohibited by applicable law.

Privacy

Our handling of information is described in the Bright Bytes Learning Privacy Policy.

Governing Law

These Terms are governed by the laws of the State of Tennessee and applicable United States federal law, without regard to conflict-of-law principles, except where another law must apply.

Changes to These Terms

We may update these Terms as the website and its services change. Updated Terms will be posted on this page with a revised effective date. Continued use of the site after an update means the revised Terms apply to future use.
